Haitibyte Email Services Agreement
This Email Terms of Service Agreement governs your use of Haitibyte’s email services Services. By using these Services, you agree to these terms, along with all applicable policies referenced herein, including our Acceptable Use Policy and Hosting Terms of Service. Continued use of the Services constitutes acceptance of any modified terms.
1. Service Requirements
1.1 Domain Ownership
To use our email services, you must:
– Own the associated domain name
– Have proper administrative access to the domain
– Maintain valid domain registration throughout service use
1.2 Account Setup
Haitibyte may provide reasonable assistance with initial configuration upon request to our support team.
2. Service Limitations
2.1 Usage Restrictions
Haitibyte may establish and modify service parameters including but not limited to:
– Maximum message storage duration
– Email sending/receiving limits
– Attachment size restrictions
– Total storage allocation per account
2.2 Data Management
Haitibyte is not responsible for:
– Deletion of messages or communications
– Failure to store transmitted content
– Data loss resulting from service limitations
2.3 Account-Specific Limits
Each email account is subject to resource allocations (including storage space) based on your selected service plan.
3. Modifications
Haitibyte reserves the right to:
– Adjust service parameters and limitations
– Update this Agreement as needed
– Implement new policies affecting service use
Changes will be effective upon posting, and your continued use constitutes acceptance.

Section 3: Data Security & Account Management
3.1 Account Security Responsibilities
You are solely responsible for:
(a) Maintaining the confidentiality of all login credentials (username, password, PIN codes)
(b) Implementing adequate security measures to protect your account
(c) All activities conducted under your account
Haitibyte will not modify account credentials without:
– Proper identity verification
– Written authorization (when required)
3.2 Ownership Disputes
In cases of partnership dissolution, legal disputes, or ownership conflicts:
– Haitibyte will remain neutral
– Accounts may be suspended pending resolution
– We bear no liability for losses during dispute periods
– You agree to indemnify Haitibyte against claims arising from such disputes
3.3 Data Transmission Security
When submitting sensitive information to Haitibyte, you must use secure communication channels approved by our support team.
Section 4: Content Management
4.1 User Content Liability
You acknowledge that:
(a) All transmitted content (messages, files, data) remains your sole responsibility
(b) Haitibyte exercises no editorial control over content
(c) We do not guarantee content accuracy, quality, or integrity

Using our services may expose you to content that is:
– Offensive
– Indecent
– Objectionable
Haitibyte disclaims all liability for such content.
Section 5: Data Backup Policy
5.1 Backup Procedures
Haitibyte maintains:
– Daily server backups
– 14-day backup retention
No guarantees are provided regarding backup integrity or availability.
5.2 Data Recovery
(a) Haitibyte-initiated errors: We will attempt data recovery at no charge
(b) User-caused data loss: Recovery attempts may incur service fees
(c) You must maintain local copies of all critical data
User Obligations & Prohibited Activities
6.1 General Requirements
You agree to:
– Comply with all contractual obligations
– Adhere to standard internet etiquette (“Netiquette”)
– Permit Haitibyte to take preventative/corrective actions as needed
6.2 Strictly Prohibited Activities
You may not use our services to:
Legal Violations
– Break any applicable local, state, national, or international laws
– Violate pharmaceutical regulations (including Ryan Haight Act)
– Distribute controlled substances without proper documentation
Security Violations
– Attempt unauthorized system access
– Conduct denial-of-service attacks
– Distribute malware or viruses
– Perform vulnerability scans without authorization
Content Violations
– Transmit illegal, obscene, or threatening material
– Distribute pirated software (“warez”)
– Operate IRC bots or spam scripts
– Host high-risk financial schemes (HYIP, prime banks programs)
Network Abuse
– Cause IP blacklisting
– Initiate DDoS attacks
– Engage in email bombing
– Spam or phishing activities
6.3 Enforcement Actions
Haitibyte reserves the right to:
(a) Determine violations at our sole discretion
(b) Take immediate action without prior notice
(c) Suspend or terminate offending accounts
(d) Permanently delete data from terminated accounts
All enforcement decisions are final. No refunds will be issued for service termination due to violations.
6.4 Liability Disclaimer
Haitibyte shall not be liable for:
– Damages resulting from enforcement actions
– Third-party claims arising from your activities
– Losses due to account suspension/termination

Content Moderation Policy
While we do not routinely monitor content, Haitibyte reserves the right (but not the obligation) to:
– Remove or restrict access to any content
– Delete emails or files that violate these terms
– Take action against objectionable material at our sole discretion
Payment Terms
1. Billing Cycle
– Your billing date corresponds to your original service purchase date
– Automatic renewals will process using your designated payment method
– Renewal rates will reflect current pricing at time of renewal
2. Renewal Process
– We will send renewal notices to your account email address
– You are responsible for maintaining accurate contact information
– Services will automatically renew unless canceled at least 3 business days prior
– Failure to renew may result in service suspension
3. Payment Failure Consequences
– Accounts unpaid after 30 days may be terminated
– Terminated accounts are subject to complete data deletion
– Account restoration requires full payment of outstanding balance
– Historical account inquiries may incur a $15 research fee
Cancellation & Refund Policy
1. Service Termination
– Initial term specified in your order will automatically renew unless canceled
– You may cancel via Help Desk at least 3 business days before renewal
– Haitibyte may terminate immediately for:
Terms violations
Operational threats
Breach of other agreements
– No refunds for terminated services
2. Refund Eligibility
– Private Email services are generally non-refundable
– Limited exceptions may be granted within 7 days of purchase
– All refund determinations are at Haitibyte’s sole discretion
Modification of Terms
Haitibyte may:
– Modify or discontinue services with notice
– Update these terms periodically
– Implement changes effective immediately upon posting
– Continue existing terms for paid services until renewal
You agree that:
– Continued use constitutes acceptance of modified terms
– Haitibyte is not liable for service modifications
– You will review terms regularly for changes
Additional Provisions
– You remain responsible for all charges during disputes
– Chargebacks may result in service restrictions
– All fees are exclusive of applicable taxes
